From this Guide it should be clear that the health and safety authorities, especially the HSE, take the threat of Legionnaires’ disease caused by poorly designed, operated or maintained water systems very seriously. As a dutyholder or responsible person you need to be aware of your legal responsibilities and follow the steps outlined in this Guide to eliminate or control the risk. Cooling towers, hot water services and spa pools carry the greatest risk but these and other lower risk water systems can be operated safely and without risk to public health with a suitable risk assessment in place and a control scheme which effectively and demonstrably controls the risk of legionella bacteria. Sustained compliance with your regulatory responsibilities will ensure you will not be on the receiving end of onerous enforcement or prosecution.
